Conditions of sale

  1. General Provisions
    L’acquisto di prodotti sul sito ornellarossi.com è regolato dalle seguenti Condizioni Generali di Vendita. I prodotti acquistati su questa piattaforma sono venduti da Ornella Rossi & C Sas, con sede legale in Italia, Via Crocette 40 – 24030 Mozzo (BG), C.F. e P.IVA n. 03233530165.
    The new General Conditions of Sale will be effective from the date of publication on ornellarossi.com.
    Ornella Rossi & C Sas shall correct errors, inaccuracies or omissions at any time without prior notice.

  2. Consumer
    Ornella Rossi & C Sas carries out its e-commerce activity exclusively towards “final consumers”. By “consumer” we mean any person who uses the website without any other business, professional or commercial purposes.
    Any users that cannot be identified as final consumer are therefore invited to refrain from concluding commercial transactions through ornellarossi.com.

  3. Orders
    Each product is presented on the website within a dedicated section showing its main features (item code and description (size and color). However, please note that some characteristics may not correspond to the real ones due to the bad quality of the monitor or the browser used.
    The purchase of products on ornellarossi.com is based on filling a form in electronic format that will be trasmitted to Ornella Rossi & C Sas. The electronic transmission of the order form implies the unconditional acceptance of the General Conditions of Sale. The order form contains a summary of the characteristics of each product ordered together with its relative price (all prices are intended in Euros and they are inclusive of all applicable taxes or duties).
    Once the customer has made the item choice by selecting the desired size and color, the product can be added to the dedicated ” shopping cart”. By entering into this section, the customer can modify the product quantity, by adding/deleting products. Once the freight conditions and costs have been taken into consideration, in order to finalize the purchase, the customer must select the desired payment method and “send” the order by clicking on “submitting order”.
    The order form will be issued once the customer has carefully read the General Conditions of Sale and the Information on the right of withdrawal as well as all the Privacy policies. The customer will also be asked to identify and/or correct any data entry error using the tools given by the website.
    For each order placed on the website, Ornella Rossi & C Sas issues an order confirmation including the order confirmation date, the shipping address and the invoice address; the order confirmation will be sent by e-mail to the customer. If required, an invoice will be issued according to the information provided. No change in the invoice will be possible further to the invoice issuing.
    At the end of the process, the order form will be archived for the period of time necessary to process the orders and within the law terms. By entering into his account, the customer can always review the status of his orders within the “orders” section.
    Ornella Rossi & C Sas will not process orders that do not give sufficient guarantees of solvency or that are incomplete/incorrect as well as in the unlikely case of products not being available. In such cases, the customer will be informed by email that the purchase contract has not been finalized and why.
    If a product is no longer available, Ornella Rossi & C Sas will communicate it promptly and, in any case, within thirty (30) days from the order date.

  4. Payments
    All payments are allowed by choosing one of the methods included into the order form (credit card, PayPal or wire transfer). In case of wire transfers, any bank fees will be charged to the customer directly.
    The transaction will be effective further to the verification of the credit card details, the receipt of the authorization from the issuing company and upon confirmation of the availability of the products.
    In case of credit card payments, the financial information (for example, credit/ debit card number and expiry date) will be managed, through an encrypted protocol, by PayPal. PayPal uses a protocol called TLS (Transport Layer Security) to encrypt communications between the seller and customer or partner. This protocol has been determined by the PCI Council and global security experts as the best way to protect online customer data.
    If, for any reason, debit of due amount fails, the sales process will be automatically terminated and the order will be cancelled.
    Ornella Rossi & C Sas will use the information entered in the website with the sole purpose of completing the purchase procedures and to allow refunds.

  5. Transport and delivery
    The products purchased on the website will be shipped to the address indicated by the customer.
    Delivery costs are charged to the customer and they are clearly highlighted on the website within the order form. The customer will receive a confirmation by email once the products have been shipped.
    The shipment will be delivered by courier from Monday to Friday, excluding holidays and National holidays. Ornella Rossi & C Sas is not responsible for unforeseeable delays.
    In any case, if no unforeseeable circumstances occur, the products will be delivered within a maximum period of 30 (thirty) days starting from the order date, unless Ornella Rossi & C Sas does not communicate – within the same term, by e-mail – the impossibility of delivering the ordered goods due to unavailability, even temporary, of the products. In such case, Ornella Rossi & C Sas will refund the amount already paid by the customer.
    The delivery of the goods is made directly to the customer or to his representative at the same address indicated by the order. Upon delivery of the goods by courier, the customer is required to check that the number of packages delivered corresponds to what is indicated in the transport document and that the package is intact and not altered. Any damage to the package or to the products or the mismatch in the number of packages must be immediately notified to the courier. Please note that once the courier’s document has been signed, the customer cannot make any claim about the external characteristics of the delivered package.

  6. Right of withdrawal
    The right to withdrawal from the contract concluded with Ornella Rossi & C Sas is guaranteed, without any penalty, within (14) working days (including Saturday), starting from the day of receipt of the products purchased on ornellarossi.com. The evaluation term will be calculated starting from the delivery document date.
    Ornella Rossi & C Sas accepts the right of withdrawal as required by current legislation. The deadline for exercising this right is 14 days from receipt of the goods, which must not have been previously used.
    To exercise the right of withdrawal, the customer is required to inform of their decision to withdraw from this contract through an explicit declaration – to be sent to Ornella Rossi & C Sas, Via Crocette 40, 24030 Mozzo (BG), email info@ornellarossi.com – within the deadline of 14 days.
    The customer must ship the product at their own expense or deliver it to any of the Ornella Rossi stores (see https://www.ornellarossi.com/negozi/) without undue delay and in any case within 14 days from the day on which the communication of withdawal from this contract has been placed. The deadline is met if the goods are returned before the 14-day period has expired.
    The costs which derive from the return of goods will be charged to the customer who is declared responsible for any value decrease which may result from mishandling of the goods. Ornella Rossi & C Sas will not be responsible for the refund or compensation of products returned which have never been received due to loss or that have been damaged, not will any refund be issued for items have been returned without its own tag, which have been worn or tampered with.
    The refund will be reduced by the costs of first shipping and will take place using the same payment method used during the initial transaction or – if agreed – will be issued through a shopping voucher that can be spent in any of the following store (see https://www.ornellarossi.com/negozi/).

  7. Product Replacement
    Ornella Rossi & C Sas offers the customers the possibility to replace the products purchased through its website. However, in order to obtain the authorization of return, the customer must strictly follow the below procedure.
    Any customer who wishes to return any goods must keep all the documentation related to the delivery as well as the original packaging and send an email to: info@ornellarossi.com. Ornella Rossi & C Sas will not accept returns of products that do not have their own tag, that have been worn or altered in their essential and qualitative characteristics or, for any reason, are found to be damaged.
    Once the authorization of return has been received (by email), the customer must ship the product at his own expense to Ornella Rossi, Via Paglia 3c, 24122 Bergamo.o.
    The shipping costs for the return of the product are chargeable to the customer, who can use his own courier for the return. In any case, shipments made by the customer without authorization or through methods different from those proposed will not be refunded and will remain exclusevely at customer’s expense. Once the defective item has been received respecting all the mentioned procedures and conditions, the replacement product will be sent to the customer by courier without any additional shipping costs.

  8. Non compliance
    In case of defective items, Ornella Rossi & C Sas will refund the paid amount following the declared methods & terms (see Par. 6 – Right of withdrawal). Refunds will be made within thirty (30) days from the date on which the seller became aware of the acceptance of the right of withdrawal; however it is made explicit that if the procedures and terms for exercising the right of withdrawal are not respected, no refund will be issued.

  9. Applicable law and dispute resolution
    The General Conditions of Sale are governed by Italian law and in particular by the legislative decree of 6th September 2005 n. 206, on the consumer code, with specific reference to the legislation on distance contracts and the legislative decree of 9th April 2003 n. 70 on certain aspects concerning electronic commerce.
